These Terms of Service ("Terms") constitute a legally binding agreement between you and Oyster Elements LLC ("Company," "we," "us," or "our"), a Delaware limited liability company with its principal place of business in Los Angeles, California. These Terms apply to all visitors, users, and customers of our website and services.
IMPORTANT NOTICE: These statements have not been evaluated by the Food and Drug Administration. Oyster Elements products are dietary supplements, not drugs, and are not intended to diagnose, treat, cure, or prevent any disease. Our products are regulated under the Dietary Supplement Health and Education Act of 1994 (DSHEA).
You should consult with a qualified healthcare provider before starting any dietary supplement regimen, particularly if you are pregnant, nursing, have a medical condition, take prescription medications, or have known allergies to shellfish or mollusks. The information on our website is for educational purposes only and does not constitute medical advice. Individual results may vary.
Our products contain oyster (mollusks). If you have a shellfish allergy, consult your physician before use. The allergen statement on our label reads: Contains: Molluscs (oyster).
You must be at least 18 years of age to purchase our products or use our services. By using our website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. We reserve the right to refuse service to anyone for any reason at any time.
All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear fraudulent or that exceed reasonable purchase quantities. You will be notified and receive a full refund if your order is cancelled.
All prices are in US dollars and subject to change without prior notice. Prices displayed at the time of order placement are the prices you will be charged. We are not responsible for pricing errors and reserve the right to cancel orders placed at incorrect prices.
Payment must be made at the time of order placement through our approved payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the total amount of your order.
We collect sales tax where required by applicable state law. Tax amounts will be calculated and displayed at checkout based on your shipping address.
If you purchase a subscription, you authorize us to automatically charge your payment method on a recurring basis at the frequency you selected (e.g., monthly). Subscription pricing may differ from one-time purchase pricing.
You may cancel, pause, or modify your subscription at any time through your account portal or by contacting us at support@oysterelements.com. Cancellations or modifications must be made at least 5 business days before your next scheduled billing date to take effect for that billing cycle. Cancellation does not entitle you to a refund for the current billing period, but you will continue to receive your product through the end of that period.
We reserve the right to change subscription pricing with 30 days' prior notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
We ship to addresses within the United States and Australia. We do not ship to P.O. Boxes for international orders. Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by carriers, weather events, customs authorities, or other circumstances beyond our control.
Risk of loss and title for products pass to you upon delivery to the carrier. If your package is lost or significantly delayed, please contact us and we will work with the carrier to resolve the issue.
International customers are responsible for any import duties, taxes, or customs fees imposed by their country. These are not included in our stated prices or shipping fees.
Oyster Elements does not offer a money-back guarantee. All sales are final unless the product is damaged, defective, or incorrectly fulfilled.
Subsequent Purchases: Unopened products in original sealed packaging may be returned within 14 days of delivery for a refund minus original shipping costs. To initiate a return, contact support@oysterelements.com with your order number.
Damaged or Incorrect Items: If you receive a damaged, defective, or incorrect item, contact us within 7 days of delivery. We will ship a replacement or issue a full refund at no cost to you, including return shipping if applicable.
Subscription Cancellations: You may cancel your subscription at any time before the next billing date through your account portal or by emailing support. Cancellations after the billing date apply to the following cycle.
Wholesale accounts are subject to verification of professional credentials and separate wholesale agreements. By applying for a wholesale account, you represent that you hold the credentials described in your application and that all information provided is accurate and complete.
Wholesale partners may not resell Oyster Elements products on third-party marketplaces (including Amazon, eBay, Walmart Marketplace, or similar platforms) without prior written authorization from Oyster Elements LLC. Wholesale pricing is confidential and may not be shared publicly. We reserve the right to terminate wholesale accounts and cancel outstanding orders for violations of these terms or the wholesale agreement.
All content on this website — including but not limited to text, images, photographs, logos, product names, slogans, marketing materials, design elements, and software — is the property of Oyster Elements LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.
You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any content without our prior written consent. Unauthorized use may result in legal action.

You agree to indemnify, defend, and hold harmless Oyster Elements LLC and its officers, directors, employees, contractors, agents, licensors, suppliers, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of our website or products, your violation of any third party's rights, or your violation of any applicable law or regulation.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree that any action arising from or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
Mandatory Arbitration: Except for claims seeking injunctive or equitable relief, any dispute, claim, or controversy arising out of or related to these Terms or our products shall be resolved through final and binding arbitration in Los Angeles County, California, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration against Oyster Elements LLC. All claims must be brought on an individual basis.
Small Claims Exception: Either party may bring individual claims in small claims court for disputes within the court's jurisdiction, provided the claim is not brought as part of a class or representative action.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a revised effective date and, where required by law, by sending an email notification to registered account holders. Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of our services.
